1. Introduction

Welcome to VJAM Solutions ("we", "us", or "our"). These Terms of Service ("Terms") govern your use of our website, services, and products. By accessing our website or engaging our services, you agree to be bound by these Terms.

2. Our Services

VJAM Solutions provides web development, website design, ICT training, and related digital services. Specific services include:

• Static website development (HTML/CSS/JS)
• CMS website development and customization
• Custom web application development
• ICT training and tutoring
• Website hosting and maintenance (optional)

All services are subject to availability and may be modified or discontinued at any time.

3. Client Responsibilities

As a client, you agree to:

• Provide accurate and complete information about your project
• Deliver requested content (text, images, logos) within agreed timelines
• Respond to design drafts and revision requests in a timely manner
• Pay all fees as outlined in your project quote or invoice
• Ensure you have the legal right to use any content you provide
• Not use our services for any illegal or unauthorized purpose

Delays caused by client non-responsiveness may extend project timelines.

4. Project Process & Timeline

Our standard project process includes the following phases:

• Discovery: Initial consultation and requirements gathering
• Design: Creation of design mockups (2 rounds of revisions included)
• Development: Building the website on a private testing link
• Review: Client testing and feedback (up to 2 revision rounds)
• Launch: Final payment and deployment to live domain

Estimated timelines are provided in your project quote. Delays caused by client feedback or content delivery will extend the timeline accordingly.

5. Pricing & Payment

Payment Terms:

• A 50% non-refundable deposit is required before work begins
• The remaining 50% balance is due before website launch
• Payments are accepted via bank transfer (Scotia, NCB), Lynx, or cash (receipt provided)
• All prices quoted in USD or JMD as specified in your quote

Late Payment: If final payment is not received within 14 days of project completion, we reserve the right to take the website offline.

Refund Policy: Deposits are non-refundable once work has commenced. Refunds for cancellations are handled as outlined in our Cancellation Policy.

6. Intellectual Property

What you own: Upon full payment, you own all custom code written specifically for your project. You also own any content (text, images, logos) you provide.

What we own: We retain ownership of any pre-existing code, frameworks, libraries, or templates used in your project. We also retain the right to display your website in our portfolio unless you request otherwise in writing.

Third-party assets: Fonts, icons, and other third-party assets are subject to their respective licenses.

You may not resell, redistribute, or claim ownership of our proprietary code or methodologies.

7. Hosting & Maintenance

Client-arranged hosting: If you choose your own hosting provider, we are not responsible for downtime, security issues, or technical problems caused by your host.

VJAM Solutions hosting: If you purchase our hosting package, we provide:

• Reliable hosting on secure servers
• Weekly backups
• Security updates
• Basic support (response within 48 hours)

Hosting can be canceled with 30 days' written notice. Upon cancellation, website files will be provided for transfer.

8. Warranties & Limitations of Liability

Our warranty: We warrant that our services will be performed in a professional and workmanlike manner. If any defects are found, we will correct them at no additional cost within 30 days of launch.

What we are NOT responsible for:

• Issues caused by third-party services (hosting, domains, plugins)
• Browser updates that break website functionality after 30 days
• Client modifications to code after handover
• Loss of revenue, data, or profits

Limitation of liability: To the maximum extent permitted by law, our total liability for any claim arising from our services is limited to the amount you paid us for the specific project.

9. Cancellation & Termination

By client: You may cancel your project at any time. Refunds are as follows:

• Before any work starts: Full deposit refunded
• After work started, before design approval: 50% of deposit refunded
• After design approval: No refund (work has been performed)

By VJAM Solutions: We reserve the right to terminate a project if:

• Client is unresponsive for more than 30 days
• Client provides false or misleading information
• Client engages in abusive or harassing behavior

In such cases, the deposit is non-refundable, and we will provide any completed work up to that point.

10. Revisions & Scope Changes

Included revisions: Your project quote includes up to 2 rounds of design revisions and 2 rounds of development revisions.

Additional revisions: Extra revision rounds are charged at $25 per round.

Scope changes: Any request to add new pages, features, or functionality not included in the original quote will be treated as a change order and quoted separately. Work will not begin on extra features without your written approval.

11. Confidentiality

We will keep all client information and project details confidential. We will not share your personal information or project data with third parties except:

• As necessary to provide our services (e.g., hosting providers, domain registrars)
• When required by law
• With your explicit consent

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Jamaica. Any disputes arising from these Terms or our services shall be resolved in the courts of Manchester, Jamaica or preferred court/s of order.

13. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page indicates when changes were made. Continued use of our website or services after changes constitutes acceptance of the new Terms.

Significant changes will be notified via email or a notice on our website.

14. Entire Agreement

These Terms, together with your project quote, contract, and our Privacy Statement, constitute the entire agreement between you and VJAM Solutions regarding our services. They supersede any prior agreements or understandings.
